CMS Proposes One-Time $9 Billion Restitution To Fix Years of 340B Underpayments

One year after a 2022 Supreme Court decision that the Centers for Medicare and Medicaid Services (CMS) did not have the authority to lower reimbursement rates to hospitals participating in the federal 340B drug discount program, CMS has proposed to pay the hospitals back for years of reduced payments with a one-time $9 billion lump sum in restitution.

A 2018 payment rule issued
